Terms and conditions (updated 13.06.2014)

 

§ 1       General information

Following general trading conditions are valid for all contracts, supplies and other achievements between Kreta-Agora and customers (both entrepreneurs and consumers). Relevant in each case is the valid version at the time of the contract conclusion. We contradict deviating regulations of the contracting party hereby expressly. All special agreements require the written confirmation on both sides. Kreta-Agora is at any time justified to change or supplement these general trading conditions including all possible plants with an appropriate term of notice. Orders coming in before the change will be worked according to the still valid old general trading conditions.

The delivery of alcohol at persons under 18 years is not permitted; the on-line order of wine or liquor contains the insurance of the buyer that he is at least 18 years old.

 

 

§ 2       Offer and conclusion of contract

The conditions for our goods are noncommittal. Smaller deviations in relation to our illustrations or descriptions are possible in reasonable context.

Online order represents an offer of the customer to Kreta-Agora for the conclusion of a sales contract.

The entrance confirmation of the order by email represents no acceptance, but informs the customer only about the fact that his order was received by Kreta-Agora.

Kreta-Agora is open to reject an online order with indication of the reasons.

Kreta-Agora is justified to limit the order to a household-usual quantity; this requires the separate report by Kreta-Agora.

The conclusion of a contract takes place under reservation.

 

 

§ 3       Prices and payment

All prices are in EURO and contain the legal value added tax. Forwarding charges are computed separately.

There is no minimum order quantity.

Valid is the manner of payment indicated for the order. Changes require the mutual agreement.

The buyer commits himself to pay the price at the latest within 10 days after receipt of the commodity. With expiration of this term the customer comes into delay of payment. The customer has to pay interest on the money debt at a value of 5% over the basis interest rate during the delay.

With nondelivery of the supply the entire forwarding charges must be paid, if necessary incl. collection fees at us.

 

 

§ 4       Delivery

Commodity available at the stock comes to the delivery address specified by the buyer normally within 3 working-days after payment.

If the commodity is not available when ordering, we strive for fastest possible supply.

Partial deliveries are permissible, if they are reasonable the buyer.

If the disregard of  the time of delivery is to due to higher force, labor disputes, unforeseeable obstacles or other circumstances which cannot be forseen by us, the period is extended appropriately. During disregard of the time of delivery for others than the above mentioned reasons the buyer is entitled to set an appropriate respite with refusal menace in written form and after unsuccessful respite withdraw from the contract. If the impossibility of the supply is based on inability of the manufacturer or our supplier, then both we and the buyer can withdraw from the contract, if the agreed date of delivery is exceeded by more than 2 months. Claims for damages because of delay or impossibility and/or default, also such, which developed up to cancellation of the contract, are impossible, unless Kreta-Agora acted deliberately or roughly negligently.

Further legal requirements and rights of the buyer because of a failure to deliver remain untouched.

With sending off of the commodity the danger from Kreta-Agora on the buyer.

 

 

§ 5       Return policy

Details are given in the Right of Withdrawal at the end of the Terms and Conditions.

We ask in the sense of a good business relation to contact us before a return.

 

 

§ 6       Retention of title

The commodity remains property of Kreta-Agora up to the complete payment by the buyer.

Kreta-Agora is justified, at behavior contrary to the terms of the agreement of the buyer, in particular with delay of payment, to withdraw from the contract and reclaim the commodity

 

 

§ 7       Guarantee

Kreta-Agora ensures that at the time of the passage of the risk the sold commodity is free of material and factory defects and has the contractually assured characteristics.
With arrival the customer has to examine the commodity immediately on lack and condition. In case of open lack these must be announced to us within 10 days after discovery in writing form, equally hidden lack. Otherwise the guarantee for these lack is void.
The guarantee amounts to 6 months starting from distribution. At complaints the purchase date must be proven by invoice. The complaint article must be sufficiently franked and returned together with a copy of the invoice to us.

The guarantee does not extend on the normal wear. The guarantee expires, if the customer changes the supplied commodity.

During the warranty Kreta-Agora has the right on free rework. A partial or complete exchange of the article is permissible.

If lack are not repaired within appropriate period, then the buyer has requirement on transformation or reduction. It is valid § for 476a BGB.

 

 

§ 8       Privacy policy

The use of the website of Kreta-Agora is possible without indication of personal data. Only with an order personal data are raised, which are necessary for a tidy settlement of  the order.

In accordance with § 28 of the Federal Law for Data Protection (BDSG) we make attentive to the fact that these in the context of the settlement necessary data (supply and bill-to-address, email address) are processed and stored by means of an EDP system in accordance with § 33 (BDSG).

Their personal data are naturally confidentially treated and passed on not on third.

The following text concerns our use of the analytics service Google-Analytics and is obligatory in the data protection:

§ 9     Other

The contract and the entire legal relations of the parties are subject to the right of the Federal Republic of Germany under exclusion of the UN CISG (convention on contracts for the international sale of goods).

If individual regulations of the present Treaty are or should be ineffective or containe any gap, then the remaining regulations of it remain untouched.
